IRS regulations fix the ACA’s ‘family glitch’ as of 2023

The Family Glitch was an unexpected consequence of the Affordable Care Act (ACA) that prevented some low-income families from receiving subsidies for health insurance. Under the ACA, employers with more than 50 full-time employees are required to provide health insurance to their employees or pay a penalty. However, if an employee is offered health insurance through their employer, they are not able to receive a subsidy on the ACA Marketplace to purchase coverage. This meant that many families with low-income earners were not able to receive subsidies even if they could not afford employer-sponsored plans. Fortunately, the Family Glitch has been fixed in 2021 and will be removed in 2023. This means that now families with lower incomes may be eligible for financial assistance when purchasing health insurance coverage through the Marketplace. Additionally, employers may now offer coverage that is affordable for employees while still allowing them to qualify for a subsidy on the Marketplace. This will make it easier for many people to get access to quality and affordable healthcare coverage.

150% Federal Poverty Level (FPL) Special Enrollment Period (SEP)

. To qualify for a Special Enrollment Period (SEP) under the Affordable Care Act (ACA), an individual must have a qualifying life event that allows them to enroll in or change their coverage outside of open enrollment. One such qualifying life event is having an income that is at or below 150% of the Federal Poverty Level (FPL). In order to qualify for a SEP based on income, an individual must provide documentation that their household income falls within the acceptable range. The acceptable range is determined by their state's guidelines and will depend on the number of people in the household. Generally speaking, if an individual’s household income is at or below 150% of the FPL, they may qualify for a SEP. The exact amount of the FPL varies depending on factors such as household size, state of residence, and age.
